TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use (“Terms”) govern the access to and use of the website www.gun-planet.com, its related pages, applications, tools, services, marketplace features, communications and any other digital services provided by GUN-PLANET in the United States (collectively, the “Site” or the “Platform”).

By registering, accessing, browsing, listing, buying, selling, offering, asking questions, sending messages or otherwise using the Platform, you agree to be legally bound by these Terms, the Privacy Policy, the Listing Policies, the Marketplace Rules and any other policies published by GUN-PLANET.

If you do not agree with these Terms, you must not access or use the Platform.

1. GUN-PLANET

GUN-PLANET is a technology company that provides online marketplace services, digital tools, classified listing services, communication tools and related e-commerce services.

GUN-PLANET operates as an online technology platform that allows legally authorized users to publish, browse, offer, sell and buy products, including firearms-related products, subject at all times to applicable federal, state and local laws.

GUN-PLANET is not a firearm dealer, broker, manufacturer, importer, exporter, gunsmith, shipping provider, escrow agent, payment intermediary, transfer agent, inspection service, licensing authority or legal advisor.

2. Marketplace Role and No Involvement in Transactions

GUN-PLANET provides a digital marketplace where users may connect with each other.

GUN-PLANET is never a party to any transaction between users.

GUN-PLANET does not own, possess, store, transfer, ship, deliver, broker, inspect, certify, investigate or guarantee any firearm, accessory, ammunition, product, listing, user, license, permit, registration, legal capacity, payment, delivery, transfer or transaction.

GUN-PLANET does not verify or guarantee that any buyer or seller is legally permitted to buy, sell, transfer, receive, possess, transport or deliver any firearm or related product.

GUN-PLANET does not guarantee the existence, legality, quality, condition, authenticity, ownership, title, registration status, serial number, transferability, safety, functionality, price, availability or lawful status of any product listed on the Platform.

All transactions, communications, payments, background checks, firearm transfers, documentation, delivery, shipping, possession and compliance obligations are the sole and exclusive responsibility of the users involved in the transaction.

3. User Legal Responsibility

Each user is solely responsible for knowing, understanding and complying with all applicable laws, regulations, rules, ordinances, executive orders, licensing requirements, registration requirements, background check requirements, transfer requirements, waiting periods, shipping restrictions and any other legal obligations applicable to their use of the Platform.

This includes, without limitation, all applicable federal, state, county, municipal and local laws and regulations relating to firearms, firearm parts, accessories, ammunition, restricted products, regulated products, possession, transportation, transfer, sale, purchase, delivery, storage, import, export, advertising and online listings.

If a user is uncertain about the legality of any listing, offer, purchase, sale, transfer, shipment, delivery, possession or transaction, the user must consult the competent authority, a licensed firearms dealer, an FFL, an attorney or the applicable regulatory body before using the Platform or proceeding with any transaction.

Use of the Platform for any purpose that is illegal, unauthorized, fraudulent, deceptive, unsafe or contrary to applicable law is strictly prohibited.

4. Age and Legal Capacity

By using the Platform, each user represents and warrants that they are at least 21 years of age, or the minimum legal age required under applicable law for the relevant product or transaction, whichever is higher.

Each user further represents and warrants that they have full legal capacity to enter into contracts and to use the Platform.

If a user accesses or uses the Platform on behalf of a company, business, trust, estate, dealer, store, organization or other legal entity, that user represents and warrants that they have full authority to bind such entity to these Terms.

GUN-PLANET may require additional information or documentation to verify a user’s identity, age, authority, account status or eligibility to use the Platform.

5. Registration and Account

To use certain services, users must create an account and complete the registration process with accurate, complete, current and truthful information.

Users agree to keep their account information updated at all times.

Each account is personal, unique and non-transferable. Users may not sell, assign, lend, share or transfer their account to any other person or entity.

Users are solely responsible for maintaining the confidentiality of their login credentials and for all activity conducted through their account.

If a user detects or suspects any unauthorized access or use of their account, they must immediately notify GUN-PLANET.

GUN-PLANET may reject, suspend, restrict, cancel or terminate any account at any time if it determines, in its sole discretion, that the user has violated these Terms, applicable law, marketplace rules, listing policies or any other Platform policy.

Users who have been suspended, disabled or removed from the Platform may not create a new account without prior written authorization from GUN-PLANET.

Users may not maintain more than one account without express authorization from GUN-PLANET.

Users included in, related to, acting on behalf of, or reasonably suspected of being connected with persons or entities included in national or international sanctions lists may not register or use the Platform.

6. User Declarations and Consent

By registering and using the Platform, each user declares, represents and warrants that:

a. they are of legal age and have legal capacity to use the Platform;

b. they are legally permitted to access and use the Platform;

c. they are legally permitted to list, offer, sell, buy, receive, possess, transfer or transport any product involved in their activity on the Platform;

d. they will comply with all applicable laws and regulations;

e. they will not use the Platform for any illegal purpose;

f. they will not attempt to evade applicable licensing, background check, transfer, registration, tax, shipping or legal requirements;

g. all information and documentation provided to GUN-PLANET is accurate, current and truthful;

h. they will not misrepresent their identity, location, legal capacity, license status, ownership, title or authority to sell or buy any product.

By accepting these Terms and the Privacy Policy, users give their express, prior and informed consent to receive email, SMS, WhatsApp, app, push or other digital communications related to account activity, marketplace operations, security, legal notices, commercial updates, promotional content and marketing communications.

Users may unsubscribe from promotional communications through the available unsubscribe mechanisms, without affecting the receipt of operational, legal, transactional, security or service-related communications.

7. Privacy and Data Use

GUN-PLANET processes personal information in accordance with its Privacy Policy.

By using the Platform, users acknowledge that GUN-PLANET may collect, store, process, analyze and use information provided by users and information generated through the Platform for purposes including identity verification, account management, fraud prevention, security, marketplace operations, customer support, analytics, compliance, legal obligations, marketing and service improvement.

GUN-PLANET may use commercial and behavioral information generated through the Platform to provide tools, applications, analytics and services intended to help sellers optimize listings, improve visibility, increase sales volume, prevent fraud and improve Platform security.

8. Listings

Users may publish listings only if they comply with these Terms, the Listing Policies and all applicable laws.

Each seller is solely responsible for the accuracy, legality and completeness of each listing.

A listing must not contain false, misleading, incomplete, illegal, unsafe, fraudulent or unauthorized information.

The seller is solely responsible for the product offered, including its existence, ownership, title, legal status, condition, description, photographs, price, documentation, transferability and compliance with all legal requirements.

GUN-PLANET may edit, remove, suspend, restrict or delete any listing, content, message, image, comment, question, answer, username or account at any time, with or without prior notice, if GUN-PLANET determines, in its sole discretion, that the content or activity violates these Terms, applicable law, user safety, marketplace integrity or Platform policies.

9. Firearms and Regulated Products

Users acknowledge that firearms, firearm parts, accessories, ammunition and related products may be heavily regulated.

Users are solely responsible for determining whether any product may be lawfully listed, offered, sold, purchased, transferred, shipped, transported, received or possessed in the relevant jurisdiction.

Users must comply with all applicable federal, state and local laws, including any requirements involving licensed firearms dealers, FFL transfers, background checks, waiting periods, permits, registrations, age restrictions, prohibited persons, prohibited locations, restricted items, shipping limitations and transfer procedures.

GUN-PLANET does not conduct background checks, does not perform firearm transfers, does not verify firearm licenses, does not verify ownership, does not validate registrations, does not inspect products and does not confirm that any transaction is lawful.

Any firearm transaction must be completed outside the Platform and in full compliance with applicable law.

Where applicable law requires the participation of a licensed firearms dealer, FFL, government agency or other authorized party, users are solely responsible for arranging and completing such process.

10. Prohibited Uses

Users may not use the Platform to:

a. violate any federal, state, local or international law;

b. list, offer, buy, sell, transfer, ship, deliver, receive or possess any product illegally;

c. misrepresent their identity, age, location, license status, legal capacity, authority, ownership or product information;

d. contact other users outside the Platform in order to evade fees, rules, controls, moderation or compliance mechanisms;

e. publish personal contact information in listings, questions, answers, comments or public areas of the Platform, unless expressly allowed by GUN-PLANET;

f. use the Platform to facilitate transactions involving prohibited persons, restricted persons or persons legally barred from possessing firearms;

g. list stolen, counterfeit, illegal, unsafe, restricted or unauthorized products;

h. publish duplicate listings, spam, misleading listings or listings in incorrect categories;

i. scrape, copy, extract, reproduce, republish or build databases using Platform content without express written authorization from GUN-PLANET;

j. reverse engineer, interfere with, disrupt, attack, overload, manipulate or compromise the Platform;

k. use the Platform for fraud, money laundering, sanctions evasion, terrorism, trafficking, harassment, threats or any unlawful purpose;

l. use ratings, reputation, comments or Platform-generated information outside GUN-PLANET without authorization;

m. create more than one account without authorization;

n. attempt to bypass suspensions, restrictions, fees, moderation, identity checks or compliance controls.

11. Communications Between Users

GUN-PLANET may provide messaging, questions and answers, comments, notifications and other communication tools.

Users must use these tools in accordance with these Terms and Platform policies.

GUN-PLANET may monitor, moderate, restrict, block, remove or review communications to protect the Platform, enforce these Terms, prevent fraud, improve user safety, comply with legal obligations or preserve marketplace integrity.

Users may not exchange personal contact information, payment instructions, delivery instructions or transaction details in a way intended to evade GUN-PLANET’s rules, fees, controls or security mechanisms.

12. Buying

Buyers are solely responsible for reviewing each listing, asking necessary questions, verifying product information, confirming legal eligibility, arranging lawful transfer procedures, complying with applicable law and completing any required documentation.

By clicking “Buy,” submitting an offer, accepting a counteroffer or otherwise initiating a transaction, the buyer acknowledges that any transaction is conducted directly with the seller and not with GUN-PLANET.

The buyer is solely responsible for paying the agreed price, complying with transfer requirements, passing any required background check, obtaining any necessary permit or authorization and receiving the product lawfully.

GUN-PLANET does not guarantee that a buyer will be legally authorized to purchase or receive any product.

13. Selling

Sellers are solely responsible for ensuring that they are legally authorized to sell, transfer or offer each product listed.

Sellers must comply with all applicable laws, including all requirements involving ownership, title, possession, transfer, background checks, FFL participation, shipping, delivery, taxes, invoices, receipts, warranties and consumer protection obligations.

Sellers must accurately describe each product and must not publish false, misleading or incomplete information.

Sellers are solely responsible for issuing any invoice, receipt, tax document, warranty, return policy or legal document required by applicable law.

GUN-PLANET does not guarantee that a seller is legally authorized to sell any product or that the product may be lawfully transferred.

14. Offers, Orders and Transactions

The Platform may allow users to make offers, accept offers, submit purchase requests, generate transaction orders or use other marketplace tools.

Any such tool is provided solely as a digital marketplace function.

The creation of a transaction order, purchase request, offer, accepted offer or confirmation notice does not mean that GUN-PLANET approves, validates, guarantees, supervises or participates in the transaction.

Users remain solely responsible for confirming the legality of the transaction and completing all legally required steps outside the Platform.

GUN-PLANET may cancel, suspend or restrict any transaction-related feature if it determines that the relevant activity may violate these Terms, Platform policies or applicable law.

15. Fees and Billing

GUN-PLANET may charge fees for the use of certain services, including listing services, promotional services, seller tools, messaging tools, premium accounts, transaction-related services, advertising services or other digital services.

Users agree to pay all applicable fees on time.

GUN-PLANET may modify, suspend, eliminate or temporarily discount fees at any time, subject to any prior notice required by applicable law or Platform policy.

Fees may be calculated based on published rates, accepted offers, transaction values, subscription plans, promotional services or other criteria established by GUN-PLANET.

Unless expressly stated otherwise, all fees are charged for technology, marketplace, advertising, access, listing, visibility, communication or digital services, and not for brokering, transferring, selling, shipping or handling firearms.

GUN-PLANET may issue invoices or receipts using the tax information provided by the user in their account.

16. Reputation, Ratings and Reviews

GUN-PLANET may provide reputation systems, ratings, reviews, comments or user activity indicators.

These tools are provided for informational purposes only and do not constitute certification, endorsement, verification, investigation or guarantee by GUN-PLANET.

Users may not manipulate ratings, create false reviews, use reputation outside the Platform without authorization or misrepresent Platform-generated reputation information.

GUN-PLANET may remove, modify, hide or restrict ratings, reviews or reputation indicators if it determines that they are false, abusive, misleading, unlawful or contrary to Platform policies.

17. Intellectual Property

GUN-PLANET and its related companies own all rights, title and interest in and to the Platform, including all websites, software, technology, databases, code, designs, images, logos, trademarks, trade names, domain names, commercial names, content, text, graphics, interfaces, features, tools, systems, developments, know-how, trade secrets and all related intellectual property.

Users are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Platform in accordance with these Terms.

This license does not grant users any right to use GUN-PLANET’s trademarks, logos, trade names, copyrighted materials, software, databases or other intellectual property without prior written authorization.

Users may not use GUN-PLANET’s intellectual property in a manner that causes confusion, implies endorsement, damages GUN-PLANET, misrepresents affiliation or violates applicable law.

Users may not copy, scrape, reproduce, distribute, republish, sell, license, extract, reverse engineer, create derivative works from or commercially exploit the Platform or its content without express written authorization.

18. License Over User Content

By publishing, uploading, submitting or sending any listing, image, text, description, logo, trademark, trade name, comment, question, answer, review, message or other content through the Platform (“User Content”), the user grants GUN-PLANET a worldwide, royalty-free, non-exclusive, transferable, sublicensable and irrevocable license to use, reproduce, publish, display, distribute, translate, adapt, modify and make available such User Content for purposes related to operating, promoting, improving, moderating and marketing the Platform.

This authorization does not transfer ownership of intellectual property rights that may exist over the User Content.

The user represents and warrants that they own or have all necessary rights, licenses, permissions and authorizations to grant this license and that the User Content does not infringe any third-party rights.

The user shall indemnify and hold GUN-PLANET harmless from any claim arising out of User Content.

19. Sanctions and Enforcement

If GUN-PLANET determines that a user has violated these Terms, Platform policies, applicable law or marketplace integrity standards, GUN-PLANET may take any action it considers appropriate, including:

a. warning the user;

b. removing, editing or restricting content;

c. suspending listings;

d. limiting account functionality;

e. temporarily or permanently suspending the account;

f. disabling or deleting the account;

g. canceling transaction-related features;

h. withholding access to services;

i. reporting activity to competent authorities where legally required or appropriate;

j. taking legal action.

GUN-PLANET may act with or without prior notice, depending on the nature and severity of the issue.

20. Cooperation With Authorities

GUN-PLANET reserves the right to cooperate with law enforcement agencies, courts, regulators, government authorities and competent legal bodies when required by law, legal process, subpoena, court order, valid governmental request or where GUN-PLANET determines in good faith that cooperation is necessary to protect users, third parties, the Platform or public safety.

GUN-PLANET may preserve, disclose or provide user information, listings, communications, account data, transaction-related data or other information in accordance with applicable law and the Privacy Policy.

21. No Warranty

The Platform is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, GUN-PLANET makes no warranties, express or implied, regarding the Platform, listings, products, users, transactions, communications, legality, availability, accuracy, reliability, safety, uninterrupted operation, merchantability, fitness for a particular purpose or non-infringement.

GUN-PLANET does not warrant that the Platform will be error-free, secure, uninterrupted or free from viruses or harmful components.

GUN-PLANET does not warrant that any listing, user, product, price, offer, transaction, transfer, license, permit, documentation, shipping arrangement or legal requirement is accurate, valid, lawful or complete.

22. Limitation of Liability

To the maximum extent permitted by applicable law, GUN-PLANET shall not be liable for any direct, indirect, incidental, consequential, special, punitive or exemplary damages arising out of or related to:

a. the use or inability to use the Platform;

b. any listing, product, offer, sale, purchase, transfer, delivery, shipment, payment or transaction between users;

c. any violation of law by any user;

d. any false, misleading, inaccurate or incomplete user content;

e. any firearm, accessory, ammunition or regulated product;

f. any background check, transfer requirement, licensing requirement or legal compliance issue;

g. any dispute between users;

h. unauthorized account access;

i. Platform interruptions, errors or technical failures;

j. removal, suspension or restriction of content or accounts.

Nothing in these Terms shall limit liability where such limitation is prohibited by applicable law.

23. Indemnity

Each user agrees to indemnify, defend and hold harmless GUN-PLANET, its related companies, owners, directors, officers, managers, employees, contractors, agents, representatives, successors and assigns from and against any and all claims, demands, actions, investigations, damages, losses, liabilities, penalties, fines, costs and expenses, including reasonable attorneys’ fees, arising out of or related to:

a. the user’s access to or use of the Platform;

b. the user’s listings, products, communications, offers, purchases, sales, transfers, shipments or transactions;

c. the user’s violation of these Terms or Platform policies;

d. the user’s violation of any applicable law or regulation;

e. the user’s User Content;

f. any dispute between users;

g. any firearm, accessory, ammunition or regulated product listed, offered, purchased, sold, transferred, shipped, delivered, received or possessed by the user;

h. any claim by another user, third party, authority, regulator or governmental body.

24. Third-Party Services and Links

The Platform may contain links to third-party websites, services, payment providers, shipping providers, FFLs, advertisers, vendors, tools or content.

GUN-PLANET does not control and is not responsible for third-party services, websites, content, conduct, terms, policies, products or transactions.

Use of third-party services is at the user’s own risk and subject to the terms and policies of such third parties.

25. Changes to the Platform and Terms

GUN-PLANET may modify, suspend, discontinue, replace or update the Platform, its services, features, tools, fees, policies or these Terms at any time.

When legally required or when changes are material, GUN-PLANET may provide prior notice through the Platform, email or other reasonable means.

Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

Changes shall not affect transactions already completed before the effective date of the change, unless required by law.

Users are responsible for reviewing the most current version of these Terms.

26. Termination

Users may stop using the Platform at any time.

GUN-PLANET may suspend, restrict, disable or terminate access to the Platform at any time if it determines that a user has violated these Terms, Platform policies, applicable law or marketplace integrity standards.

Termination does not release users from obligations incurred before termination, including payment obligations, indemnity obligations and legal compliance obligations.

27. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of [STATE], United States of America, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms, the Platform or the services provided by GUN-PLANET shall be submitted to the competent state or federal courts located in [COUNTY], [STATE], unless otherwise required by applicable law.

Users consent to the personal jurisdiction and venue of such courts.

28. Consumer Protection and Mandatory Law

Nothing in these Terms shall exclude, restrict or limit any right that cannot be excluded, restricted or limited under applicable law.

Where consumer protection laws, firearm laws, data protection laws or other mandatory rules apply, these Terms shall be interpreted in accordance with such laws.

29. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

30. Entire Agreement

These Terms, together with the Privacy Policy, Listing Policies, Marketplace Rules and any additional policies published by GUN-PLANET, constitute the entire agreement between the user and GUN-PLANET regarding use of the Platform.

31. Acceptance

By clicking “Accept,” creating an account, accessing the Platform, publishing a listing, sending a message, making an offer, clicking “Buy,” or otherwise using the Platform, the user electronically represents and agrees that they have read, understood and accepted these Terms and agree to be legally bound by them.

The user further certifies that they are legally authorized to use the Platform and that all activity conducted through their account will comply with applicable law.

MARKETPLACE RULES ANNEX

This Marketplace Rules Annex forms an integral part of the GUN-PLANET Terms and Conditions of Use.

1. What is the Marketplace?

The Marketplace is the online platform operated by GUN-PLANET where users may publish, browse, offer, sell and buy products, subject to these Terms and all applicable laws.

GUN-PLANET provides the technology platform only. GUN-PLANET does not participate in transactions between users.

2. Sellers

To sell a product on the Platform, the seller must comply with all legal requirements, permits, licenses, authorizations and procedures required by applicable law.

The seller must:

a. publish accurate and lawful listings;

b. own or be legally authorized to sell the product;

c. comply with all applicable firearm laws and transfer requirements;

d. comply with all applicable tax, invoice, receipt and consumer protection obligations;

e. respond truthfully to buyer questions;

f. avoid publishing prohibited, illegal, misleading or duplicate listings;

g. complete any legally required transfer through the appropriate licensed or authorized party.

3. Buyers

To buy a product through the Platform, the buyer must comply with all legal requirements, permits, licenses, authorizations and procedures required by applicable law.

The buyer must:

a. verify the product information before buying;

b. confirm their legal eligibility to buy, receive, possess and transport the product;

c. comply with all applicable background check, transfer, permit, license and registration requirements;

d. pay the agreed price directly to the seller or through any permitted method agreed between the parties;

e. complete any legally required transfer through the appropriate licensed or authorized party.

4. Questions, Answers and Messaging

Users may use the Platform’s communication tools to ask questions and exchange information related to listings.

Users may not use communications to evade Platform rules, fees, moderation, compliance controls or legal requirements.

GUN-PLANET may moderate, remove or restrict communications that violate these Terms, applicable law or Platform policies.

5. Prohibited Listings

GUN-PLANET may prohibit or restrict categories of products in its sole discretion.

Users may not publish any product that is illegal, stolen, counterfeit, unsafe, misrepresented, restricted, prohibited by law or prohibited by GUN-PLANET’s Listing Policies.

GUN-PLANET may remove any prohibited listing without prior notice.

6. Claims and Disputes Between Users

Any dispute between buyer and seller is solely between those users.

GUN-PLANET may provide communication tools or support channels, but it is not obligated to mediate, resolve, guarantee, refund, compensate or enforce any transaction between users.

Users remain solely responsible for resolving disputes and complying with applicable law.

LISTING POLICIES

These Listing Policies form an integral part of the GUN-PLANET Terms and Conditions of Use.

By accepting the Terms, users also accept these Listing Policies.

1. General Rule

All listings must comply with applicable law, these Terms, the Marketplace Rules and all Platform policies.

GUN-PLANET may remove, edit, suspend or restrict any listing that violates these rules or that GUN-PLANET considers inappropriate, unsafe, misleading, unlawful or harmful to marketplace integrity.

2. Currency

Listing prices must be expressed in United States dollars or in any other currency expressly authorized by GUN-PLANET for the applicable market.

3. Listing Accuracy

Listings must accurately describe the product offered, including brand, model, condition, price, location, relevant documentation and any other material information.

Photographs must correspond to the actual product offered, unless expressly identified as reference images.

4. Legal Compliance

Users may list only products that they are legally authorized to offer and that may be lawfully sold, transferred and possessed under applicable law.

The publication of a listing on the Platform does not mean that GUN-PLANET has approved, verified or certified the legality of the product or transaction.

5. Duplicate and Misleading Listings

Users may not publish duplicate listings, misleading listings, false prices, false availability, incorrect categories or content intended to manipulate visibility or deceive other users.

6. Contact Information

Users may not include personal contact information in listings, questions, answers, public comments or other areas where GUN-PLANET prohibits such information.

This includes, without limitation, phone numbers, email addresses, social media profiles, messaging handles, external links or coded attempts to bypass Platform communication tools.

7. Enforcement

Violation of these Listing Policies may result in removal of content, suspension of listings, account restrictions, temporary suspension, permanent account termination and any other measures available to GUN-PLANET under these Terms and applicable law.
